The Praha 1 District Court judgment in favour of Komerční banka over mortgage loan administration bank fees case

Prague, 18-7-2013 — /europawire.eu/ — The Praha 1 District Court delivered yesterday its judgment in favour of Komerční banka in the case of a client demanding refund of the bank fees charged for mortgage loan administration. Within a short span of time, this is another judgment of Czech courts in favour of banks in such disputes.

“We continue to be convinced, and the competent court agreed with us in this respect, that the loan administration fees are charged to clients in full compliance with all the relevant laws. The loan administration fees, the refund of which is being demanded by some clients, were duly agreed in the loan agreement, and clients received information about these fees before signing the loan agreement, and they entered into the loan agreement completely of their free will following their consideration of alternatives in the form of banks’ offers on the highly competitive bank market in the Czech Republic,” said Martin Křivda of Komerční banka’s Legal Department.

In its decision yesterday, the court upheld this opinion of banks and a number of independent lawyers.
